Legal notice for Patients

Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the General Data Protection Regulation, GDPR), we inform you that:

  1. The controller of your personal data is «WOLA MEDICAL GROUP» Limited Liability Company (Healthcare entity «STOMATOLOGIA WOLA»), KRS 0001070319, REGON 526996080.
  2. You can contact the Controller by e-mail: info@dev.stomatologiadlaswoich.com.pl, by phone: +48 731 705 136, or in writing at the company’s registered address.
  3. Your personal data will be processed for the Controller’s medical activity, in particular to provide medical (rehabilitation) services and keep medical records required by law.
  4. Legal basis for processing your data
  • for medical activity, including keeping medical records, is Article 6(1)(c) GDPR in conjunction with the Act of 15 April 2011 on medical activity and the Act of 6 November 2008 on patients’ rights and the Patients’ Rights Ombudsman. Processing necessary to protect vital interests of the patient may also be based on Article 6(1)(d) GDPR. Where special-category data are processed, the legal basis is Article 9(2)(c) and (h) GDPR.
  • furthermore, under Article 6(1)(f) GDPR we process personal data for purposes of the Controller’s legitimate interests (facility monitoring for security, pursuing claims).
  1. While keeping all data-security safeguards, we may share your data — besides persons authorised by the Controller — with other parties, in particular:
  • other healthcare providers to ensure continuity of care and access to medical services;
  • providers of technical and organisational services supporting our medical care
  • other organisations processing data on our behalf (e.g. medical laboratories)
  1. Your personal data will be stored for: 20 years from the end of the calendar year of the last entry, except:
  • medical records in case of death due to bodily injury or poisoning, kept for 30 years from the end of the calendar year of death;
  • medical records of children under 2 years of age, kept for 22 years;
  • referrals for examinations or doctors’ orders, kept for:
    1. 5 years from the end of the calendar year in which the medical service covered by the referral or order was provided;
    2. 2 years from the end of the calendar year in which the referral was issued — if the service was not provided because the patient missed the agreed appointment, except where the patient received the referral;
  1. You have the right of access to your data and the rights to rectification, erasure, restriction of processing, data portability, objection, and to lodge a complaint with a supervisory authority.
  2. Providing personal data is voluntary, but without it we cannot provide medical services.
  3. Your data will not be processed in an automated way or profiled.
